In our first legal action, we won an important jurisprudence from the Constitutional Chamber (Sala IV).
Bloque de Cocles halted the illegal actions of the ADITIK of giving possession of the Plaza de Cocles to the State, stopping a dangerous precedent being set against property owners in the ZMT.
We have expert legal guidance on the implementation of a Consulta Indigena and we will be working to ensure the Consulta Indigena is implemented in accordance with Convention 169, “prior, informed and of good faith"
The State has recognized the main claims of our legal thesis.
Having achieved our phase 1 goals, we've moved on to the important negotiation phase with the State. We have initiated dialogue with all 3 powers of the State - the Executive, Legislative and Judicial Powers.

A different neighborhood group, the Association of Vecinos, is pushing the Afro-Caribe tribal solution, which does not represent property owners in Cocles. The Afro tribal solution is misguided and harmful to good-faith property owners.
Otro grupo vecinal, la Asociación de Vecinos, promueve la solución tribal afrocaribeña, la cual no representa a los propietarios de Cocles. Esta solución es errónea y perjudicial para los propietarios de buena fe. Estudios históricos de registro demuestran que estas tierras fueron tituladas en la década de 1890 y nunca fueron territorio indígena. Los pueblos indígenas nunca habitaron las tierras costeras. Prueba de ello es que la tierra fue titulada inicialmente a nombre de un ciudadano estadounidense, el magnate ferroviario Minor Cooper Keith, y la United Fruit Company. La resolución constitucional de 2019 para reintegrar Cocles a la Reserva Kekoldi se realizó sin una Consulta Indígena y en contra de la voluntad del Consejo de Ancianos. El Consejo de Ancianos de Kekoldi testifica que su territorio nunca incluyó Cocles. El Estado de Costa Rica violó los derechos constitucionales de los propietarios de Cocles, consagrados en el Artículo 45 de la Constitución y el Artículo 21 de la Convención Americana sobre Derechos Humanos.

In 2025, the ADITIK began serving usurpation notices to property owners on Calle el Tucan

The Situation is Evolving Quickly

In 2019, the First Chamber of the Supreme Court of Justice overturned a decree of 1996 and reinstated much of Cocles into the Keköldi Reserve, causing good-faith property owners to suffer with legal uncertainty.

STRATEGY
Our well founded Road-Map has achieved all it's objectives to date. Our Road-Map is implemented by legal experts in human rights, indigenous matters and the constitution, ensuring legal fundamental objectives of a law project are met.
RESULTS
We have already achieved results, including a jurisprudence before the Constitutional Chamber of the Supreme Court of Justice! Our legal thesis has been recognized and proven in practice by the State in a defense of our community space.
